1. Acceptance of These Terms
These Terms of Service (the "Terms") form a binding agreement between you and JumpEnglish ("we", "our", or "us"). By downloading, installing, or using the Jump & Say mobile application (the "App"), you agree to be bound by these Terms.
If you do not agree, do not use the App. You may uninstall the App at any time to end this agreement.
2. Description of the Service
Jump & Say is an English-learning application for children aged 3–12 that combines interactive stories ("Picture Books" and "Big Adventure" levels) with body-motion mini-games. A free tier includes early content (Level 0 and selected sample books); a paid subscription unlocks the full curriculum.
3. Eligibility & Parental Responsibility
The App is offered to users in any country where the Apple App Store distributes it. You must be at least the age of digital consent in your country (18 in most jurisdictions) to enter into a subscription contract.
4. Accounts & On-Device Data
The App does not require an account. Learning progress, a nickname, age range, avatar preference, and language setting are stored locally on the user's device. Uninstalling the App, restoring the device, or using the in-app Reset All Data control will erase this information.
5. Subscriptions, Auto-Renewal & Billing
The App offers optional auto-renewing subscriptions, sold exclusively through Apple's App Store using StoreKit 2.
5.1 Plans & Prices
- Weekly — ¥9.99 / week (or the equivalent in your local currency charged by Apple).
- Monthly — ¥24.99 / month.
- Yearly — ¥198.00 / year.
Apple may vary the local price based on your country, taxes, and currency conversion. The exact price shown in the in-app purchase sheet (before you confirm) is the price you will be billed.
5.2 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
5.3 How to Cancel
You can manage and cancel your subscription at any time from your iOS device:
Settings → [your name] → Subscriptions → Jump & Say → Cancel Subscription.
Cancellation takes effect at the end of your current billing period. You will continue to have access to the paid content until that date.
5.4 Free Trials
If a free trial is offered, you will be charged the subscription price after the trial ends unless you cancel at least 24 hours before the trial expires. Any unused portion of a free trial period is forfeited when you purchase a subscription.
5.5 Refunds
All billing and refund handling is performed by Apple. To request a refund, follow the instructions at Apple — Request a refund for App Store purchases. We do not have the ability to issue refunds directly.
5.6 Price Changes
We may change subscription prices for upcoming billing periods. If we do, Apple will notify you in advance and ask for your consent before the renewal is charged at the new price.
6. License & Intellectual Property
6.1 Our Content
The App, including all illustrations, audio recordings, Level/Book curricula, mascot artwork, animations, and software code, is owned by JumpEnglish or its licensors and is protected by copyright, trademark, and other laws.
6.2 Limited License to You
Subject to your compliance with these Terms and payment of any applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices associated with your Apple ID for personal, non-commercial, family educational use.
6.3 Restrictions
You may not, and may not allow any third party to:
- Copy, modify, translate, or create derivative works of the App.
- Reverse-engineer, decompile, or attempt to extract the source code of the App (except as permitted by applicable law).
- Resell, rent, lease, sublicense, or otherwise commercially exploit the App or its content.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
- Use the App to train artificial-intelligence models or to build competing products.
7. Acceptable Use
You agree not to use the App:
- For any unlawful purpose or in violation of any applicable local, national, or international law.
- To upload or otherwise transmit any content that is infringing, obscene, harmful, or deceptive.
- To interfere with or disrupt the integrity, security, or performance of the App.
- To attempt to gain unauthorized access to any portion of the App, related systems, or networks.
Because the App is designed for children, you agree to supervise your child's use of the motion-control and camera features to ensure they operate in a safe physical environment.
8. Third-Party Content
The App may link to or display content from third parties (for example, Apple's App Store support pages). We are not responsible for the accuracy, legality, or content of any third-party sites or services, and linking does not imply endorsement.
9. Health, Safety & Motion Controls
The App uses the device camera and accelerometer to detect the player's gross body movements. Please observe these safety guidelines:
- Always play in an open area clear of furniture, walls, stairs, and other people.
- Make sure the floor is non-slip and the lighting is adequate.
- Stop immediately if the child feels dizzy, tired, or uncomfortable.
- Take a short break every 15–20 minutes of active play.
- If the child has any medical condition (heart, joint, vision, vestibular, or neurological), consult a physician before use.
The motion-sensitivity slider and a "Touch-Only" mode are available in Settings → Controls for families who prefer a lower-impact experience.
10. Disclaimer of Warranties
To the maximum extent permitted by law, the App and all content are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of learning content.
We do not warrant that the App will be uninterrupted, error-free, or that all learning outcomes will match the expectations of any individual child.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall JumpEnglish, its officers, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of data, loss of profit, or loss of goodwill, arising out of or in connection with your use of (or inability to use) the App.
Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the amount you have paid for the App or a subscription in the twelve (12) months preceding the claim, or (b) USD $50.
Some jurisdictions do not allow the limitation of certain damages; in those cases the limitations above apply to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify and hold JumpEnglish harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the App, or your violation of any law or third-party right.
13. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms. You may terminate at any time by uninstalling the App and cancelling any active subscription through Apple. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will survive.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the jurisdiction where JumpEnglish is incorporated, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
The parties will first attempt to resolve any dispute informally by contacting sxmayafei@163.com. If a dispute cannot be resolved within 30 days, you agree to submit it to the competent courts of that jurisdiction, except where consumer-protection laws give you the right to bring an action in your country of residence.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Effective Date" above. For material changes we will display an in-app notice the next time you open Jump & Say; for non-material changes, your continued use of the App indicates acceptance of the revised Terms.
